The Maternal Movement – Terms & Conditions

The Creative Hearts CIC

These Terms & Conditions apply specifically to participation in The Maternal Movement, a free community movement and wellbeing project delivered by The Creative Hearts CIC.

By booking a place and participating in the programme, you agree to these Terms & Conditions.

1. About The Maternal Movement

The Maternal Movement provides free movement and wellbeing sessions for women during pregnancy and for mothers with babies and young children up to 24 months after birth.

The programme is designed to provide an inclusive, welcoming and supportive community environment where participants can take part in gentle movement and wellbeing activities.

Places are subject to availability and are intended for the eligible participants described in the programme information.

2. Booking and Participation

A booking is required to attend the sessions.

By making a booking, you confirm that the information you provide is accurate and that you meet the participation requirements for the programme.

Your booking is for the named participant only and should not be transferred to another person without prior agreement from The Creative Hearts CIC.

The Creative Hearts CIC reserves the right to refuse or cancel a booking where necessary to protect the safety, wellbeing or proper operation of the programme.

3. Free Community Provision

The Maternal Movement is provided free of charge to participants.

There is no requirement to make a payment in order to attend. Where voluntary donations or other forms of support are offered, these are entirely optional and do not affect eligibility to participate.

4. Attendance and Cancellations

Participants are asked to attend the sessions they have booked and to notify The Creative Hearts CIC as soon as possible if they are unable to attend.

Because places are limited, repeated non-attendance without notice may result in the participant’s future bookings being cancelled or their place being offered to someone on the waiting list.

If you are unable to attend a session, please cancel your booking or contact The Creative Hearts CIC as soon as possible.

The Creative Hearts CIC may cancel, change or reschedule a session where necessary, including because of venue availability, facilitator availability, safety, weather, operational circumstances or other circumstances outside its reasonable control.

5. Health, Pregnancy and Postnatal Participation

The Maternal Movement involves physical movement and exercise.

Participants are responsible for informing the facilitator of any relevant pregnancy, postnatal, medical or physical circumstances that may affect their ability to participate safely.

Participants should only take part in activities that are appropriate for their individual circumstances and should follow the guidance given by the session facilitator.

The Maternal Movement is a community movement programme and does not provide medical diagnosis, treatment or individual medical advice.

If you are unsure whether a particular activity is suitable for you, you should seek appropriate advice from your GP, midwife, health professional or other qualified professional before participating.

Participants must immediately inform the facilitator if they feel unwell, experience pain, dizziness, discomfort or any other concern during a session.

6. Participant Responsibility

Participants are responsible for taking part within their own physical capabilities.

Facilitators may provide general guidance and modifications, but participants remain responsible for deciding whether to undertake a particular movement or activity.

Participants should wear suitable clothing and footwear where appropriate and follow any reasonable safety instructions given by the facilitator or venue.

7. Babies and Children

Where the session is intended for mothers with babies or young children, participants remain responsible for the supervision and safety of their child throughout the session.

Babies and children must not be left unattended.

The facilitator may ask a participant to modify or stop an activity where this is reasonably necessary for the safety of the participant, their child, other participants or staff.

8. Photography and Video

Photography and video recording may take place during Maternal Movement sessions as an integral part of documenting and sharing the project, its activities, community and impact.

Images and recordings may be used by The Creative Hearts CIC in connection with the project and its community work, including on its website, social media, promotional materials, reports, presentations and other communications.

By booking and participating in the Maternal Movement project, participants acknowledge that photography and video recording may take place during sessions and that they may appear in project-related images or recordings.

Where a participant has specifically indicated that they do not wish to appear in photography or video, The Creative Hearts CIC will take reasonable steps to respect that request and avoid using identifiable images or recordings of that participant.

Participants should inform the facilitator before or during a session if they have concerns about being identifiable in particular photographs or recordings.

9. Use of Participant Images and Project Documentation

The Creative Hearts CIC may document the delivery and impact of The Maternal Movement through photographs, video, participant feedback, anonymised information and other project documentation.

Any personal information will be handled in accordance with The Creative Hearts CIC’s applicable privacy and data protection policies.

Photography and video will be managed with consideration for participants’ privacy and dignity, particularly where babies, children or other individuals may appear in recordings.

10. Personal Information and Data Protection

Information provided when booking or participating in The Maternal Movement will be handled in accordance with The Creative Hearts CIC’s Privacy Policy and applicable UK data protection legislation.

Personal information will only be collected, stored and used for legitimate purposes connected with administering, delivering, monitoring and communicating about the programme and the organisation’s activities.

Participants can contact The Creative Hearts CIC if they have questions about how their personal information is used.

11. Respectful and Inclusive Participation

The Maternal Movement is intended to be a welcoming and inclusive community programme.

Participants are expected to treat facilitators, volunteers, venue staff and other participants with respect.

Bullying, harassment, discriminatory behaviour, threatening behaviour or conduct that places others at risk will not be accepted.

The Creative Hearts CIC may ask a participant to leave a session or may cancel their future bookings where behaviour creates a serious concern for the safety or wellbeing of others.

12. Venues and Facilities

Sessions may take place at different community or studio venues.

Participants are expected to follow the reasonable rules and safety requirements of the venue.

The Creative Hearts CIC is not responsible for personal belongings that are lost, damaged or stolen during a session.

13. Changes to the Programme

The Creative Hearts CIC may make reasonable changes to session times, venues, facilitators or programme arrangements where necessary.

Where a significant change affects a booked session, reasonable efforts will be made to notify affected participants.

14. Safeguarding

The Creative Hearts CIC is committed to maintaining a safe environment for participants, children, volunteers and staff.

Any safeguarding concern should be reported to a member of The Creative Hearts CIC team as soon as possible.

The organisation may take appropriate action where there is a concern regarding the safety or wellbeing of a participant, child, volunteer, facilitator or another person involved in the programme.

15. Liability

The Creative Hearts CIC takes reasonable steps to provide sessions in a safe and appropriate environment.

Participants remain responsible for participating within their own capabilities and for following reasonable safety instructions.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under UK law.

16. Acceptance of These Terms

By booking a place on The Maternal Movement, you confirm that you have read and understood these Terms & Conditions and agree to comply with them while participating in the programme.

These Terms & Conditions should be read together with The Creative Hearts CIC’s Privacy Policy and other applicable organisational policies.
